1. Compliance Disclaimer

This promotion is run by Kirsty Turner Art (“the Organiser”). This promotion is in no way sponsored, endorsed, administered by, or associated with Meta, Facebook, or Instagram. By entering, each entrant confirms that they completely release Meta, Facebook, and Instagram from any liability arising out of or connected with this promotion. Entrants understand that they are providing their information to the Organiser and not to Meta, Facebook, or Instagram. This wording reflects Meta’s published promotion requirements.

2. Promotion Period

The promotion opens at 10:00 GMT on 14/04/26 and closes on 01/05/26 GMT (“Promotion Period”). For administration purposes, where no separate closing time is stated in the live promotional post, the Organiser will treat the closing time as 23:59 GMT on 01/05/26. Entries received before the opening time or after the closing date and time will not be accepted.

3. Eligibility

Entry is open only to natural persons who, at the time of entry, are:

  1. aged 18 years or over; and

  2. legal residents of the United Kingdom or the United States of America.

The following persons are not eligible to enter:

  • the Organiser;

  • any employee, contractor, agent, or immediate family member of the Organiser directly involved in the administration of the promotion; and

  • any person using fraudulent means to enter.

The Organiser reserves the right to require reasonable proof of age, identity, and residency before awarding the prize.

4. How to Enter

To enter, eligible participants must, during the Promotion Period:

  1. follow the instructions in the promotional post on Instagram and/or Facebook; and

  2. submit a valid email address through the Organiser’s designated email sign-up form or landing page.

No purchase is necessary to enter or win.

Only one entry per person is permitted. For these purposes, duplicate entries may be identified by matching email address, name, IP address, device data, or other reasonably available indicators. Where a person submits multiple entries, only the first valid entry may be counted, and the Organiser may disqualify duplicate or suspicious entries at its discretion.

Entries that are incomplete, illegible, corrupted, altered, generated by script, macro, bot, AI automation, commercial contest-subscription service, or other automated means are void.

5. Entry Conditions and Disqualification

The Organiser may disqualify any entrant, entry, or purported winner if the Organiser reasonably believes that:

  • the entrant has breached these Terms & Conditions;

  • the entry is fraudulent, misleading, bulk-generated, or automated;

  • false details have been provided;

  • the entrant has attempted to manipulate the promotion, website, entry process, or random draw;

  • the entrant has acted in a way that is abusive, deceptive, unlawful, or contrary to the spirit of the promotion.

The Organiser’s decision on eligibility, validity of entries, and disqualification is final, subject to applicable law.

6. Prize

There is one (1) prize available:

  • One signed 8 x 10 inch giclée print of “Marilyn in Grey”

  • Approximate retail value: £200

The prize is non-transferable, non-exchangeable, and no cash alternative will be offered, except that the Organiser reserves the right to substitute the prize with one of equal or greater value if the advertised prize becomes unavailable due to circumstances beyond the Organiser’s reasonable control.

7. Winner Selection and Notification

One winner will be selected at random from all valid entries received during the Promotion Period within a reasonable time after the promotion closes.

The winner will be contacted using the email address used to enter. The Organiser may also, at their discretion, announce the winner’s first name and broad location (for example, county/state or town/city) on the Organiser’s social channels or by email, unless the winner objects where permitted by law.

The selected winner must respond within 7 days of the notification email being sent. If the winner does not respond within that period, is found to be ineligible, declines the prize, or cannot be contacted after reasonable efforts, the Organiser may withdraw the prize and select an alternative winner at random from the remaining valid entries.

8. Prize Fulfilment and Shipping Costs

The prize will be dispatched by the Organiser to the winner using a delivery method chosen by the Organiser within a reasonable time after the winner has validly claimed the prize and provided a deliverable postal address.

The winner is not responsible for any shipping costs. Standard shipping charges for delivery of the prize will be paid by the Organiser.

The Organiser intends to ship only to addresses within the United Kingdom and the United States of America, consistent with the eligibility criteria. The winner is responsible for providing accurate delivery information. The Organiser is not responsible for delays caused by postal carriers, customs handling, incorrect address details supplied by the winner, or events outside the Organiser’s reasonable control.

If import duties, taxes, or customs charges are imposed by the destination country despite the Organiser paying shipping costs, those charges will be the responsibility of the recipient unless the Organiser expressly agrees otherwise in writing.

9. Liability Limitations

To the fullest extent permitted by law, the Organiser will not be liable for:

  • lost, late, delayed, incomplete, corrupted, misdirected, or undeliverable entries;

  • failures in websites, landing pages, email systems, internet connections, social platforms, hardware, software, or telecommunications systems;

  • unauthorised human intervention, fraud, or technical error affecting the administration of the promotion;

  • postal delays, loss, or damage in transit after dispatch, except where liability cannot lawfully be excluded;

  • any inability to award the prize because of incorrect contact or address information supplied by the entrant.

Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

10. Data Collection and Privacy

By entering, entrants acknowledge that the Organiser will collect and process personal data including name, email address, entry metadata, and, if applicable, postal address for the purposes of:

  • administering the promotion;

  • verifying eligibility;

  • contacting the winner;

  • delivering the prize;

  • maintaining an audit trail of the promotion; and

  • where the entrant has opted in or the sign-up form clearly states it, sending marketing emails in accordance with applicable law.

The Organiser will store personal data only for as long as reasonably necessary for the purposes above, and will use reasonable organisational and technical measures to protect it. Entrants in the UK may have rights under the UK GDPR and Data Protection Act 2018, including rights of access, correction, erasure, restriction, objection, and complaint to the ICO. The ICO says privacy information should clearly explain purposes, lawful bases, sharing, retention, rights, and complaints.

For entrants in the United States, the Organiser will handle personal information in line with the published Privacy Policy and applicable US state privacy laws to the extent they apply. Entrants should review the Privacy Policy carefully before entering.

11. Publicity

By accepting the prize, the winner agrees that the Organiser may request permission to use the winner’s first name and general location for reasonable post-promotion publicity on the Organiser’s website, email, Instagram, and Facebook channels. No entrant is required to participate in publicity beyond what is necessary to administer the promotion, unless they separately agree.

12. Platform Conduct

Entrants must not tag themselves inaccurately in photographs or content in which they do not appear, and must not use Facebook or Instagram functionality in a manner that breaches Meta’s promotion rules or community standards. This reflects Instagram’s published promotions guidance.

13. Force Majeure

The Organiser will not be liable for any failure to perform, delay, disruption, or inability to complete the promotion where caused by events beyond the Organiser’s reasonable control, including but not limited to acts of God, flood, fire, storm, war, civil disturbance, epidemic, pandemic, labour dispute, postal disruption, supply-chain failure, cyberattack, platform outage, changes to Meta platform functionality, legal or regulatory action, or interruption of internet or utility services.

If such an event occurs, the Organiser reserves the right to suspend, vary, shorten, extend, or cancel the promotion, or substitute the prize, where this is necessary and proportionate.

14. Governing Law and Jurisdiction

These Terms & Conditions and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales.

Subject to the Dispute Resolution section below, the courts of England and Wales shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with this promotion, except where mandatory consumer-law rights require otherwise.

15. Dispute Resolution

If a dispute arises in connection with the promotion, the entrant should first contact the Organiser at kirstyturner.art@gmail.com with full details of the complaint. The parties will use reasonable efforts to resolve the dispute informally within 30 days.

If the dispute is not resolved informally:

  • a consumer resident in England or Wales may bring a claim in the courts of England and Wales;

  • a consumer resident in Scotland or Northern Ireland may also have rights to bring proceedings in their home jurisdiction where applicable;

  • for low-value claims, either party may consider using the relevant small claims procedure where available.

Nothing in this section removes any mandatory statutory rights an entrant may have.

16. Organiser’s Right to Amend or Cancel

The Organiser reserves the right, where reasonably necessary, to amend these Terms & Conditions, suspend the promotion, or cancel the promotion if circumstances arise that make this unavoidable, including fraud, technical failure, legal or regulatory issues, or events beyond the Organiser’s control. Any material changes will be posted by the Organiser in a reasonably prominent manner.

17. Severability

If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
